Music Duo Academy Terms of Use Agreement
Effective Date: November 10, 2025 / Last Revised May 14, 2026
1. Acceptance of Terms
This Terms of Use Agreement (the “Agreement”) is entered into by and between you (the “User”) and Music Duo Academy, a division of Splendor Productions LLC (“Company,” “we,” or “us”). These terms govern your access to and use of musicduoacademy.com, including any associated content, features, courses, videos, materials, or services offered through the site (collectively, the “Website”).
By using this Website, you accept and agree to abide by these Terms of Use and our Privacy Policy, located at https://musicduoacademy.com/privacy-policy, which is incorporated herein by reference. If you do not agree, you must not use the Website.
2. Eligibility and Parental Consent
Music Duo Academy courses are designed for use by children under the supervision of a parent, guardian, or educator. The parent, guardian, or educator is the legal account holder responsible for all activity on the account.
No one under age 18 may provide personal information without the explicit consent of a legally authorized adult. If you believe we have inadvertently collected information from a child without proper consent, please contact us immediately at support@musicduoacademy.com.
In cases where a student is enrolled through an authorized institutional partner, the parent or guardian account will be created by Music Duo Academy using contact information provided by the partnering institution. By completing account registration and accepting these Terms of Use, the parent or guardian confirms their consent to the account setup and all associated communications.
3. Changes to the Agreement
We reserve the right to modify or update this Agreement at any time. Any changes are effective immediately upon posting to the Website. Continued use of the Website after changes are made constitutes acceptance of the revised terms.
4. Account Security and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account or breach of security. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Intellectual Property Rights
All content on the Website—including but not limited to videos, songs, lesson materials, images, audio recordings, quizzes, designs, and written materials—is the intellectual property of Splendor Productions LLC or its licensors. These materials are protected under U.S. and international copyright and trademark laws.
You may use the Website and its materials solely for your personal, non-commercial educational use. You may not share, distribute, modify, reproduce, or publicly display any content beyond your immediate household (for homeschool users) or licensed classroom (for educators) without express written permission from the Company.
6. Artificial Intelligence and Data Use
You agree not to, and will not permit any third party to, input, upload, copy, or otherwise submit any portion of the Music Duo Academy platform—including but not limited to videos, lesson materials, audio, images, assessments, or other proprietary content—into any artificial intelligence (AI) system, machine learning model, neural network, or automated content-generation tool for training, analysis, dataset creation, or any similar purpose.
Use of Music Duo Academy content for AI dataset creation, model training, algorithmic analysis, or automated replication—whether commercial or non-commercial—is strictly prohibited. This restriction applies to all public, private, open-source, or commercial AI systems. You may not use any AI-assisted technologies to reproduce, simulate, or derive new works based on Music Duo Academy content without our express written consent.
7. Refunds and Payment Terms
Music Duo Academy courses are year-long educational programs. Monthly payments represent a 12-month payment plan for the full course, not a cancel-anytime subscription. Cancellation does not terminate payment obligations for the plan.
Refunds are available only during the 14-day trial period from the date of initial enrollment. After this period, no refunds are provided.
If you wish to request an exception due to extraordinary circumstances, you may contact support@musicduoacademy.com, and your request will be reviewed at our discretion.
8. Prohibited Uses
You may use the Website only for lawful purposes. You agree not to:
– Reproduce, distribute, or share course materials outside of licensed use.
– Attempt to access, modify, or disrupt the Website or its data.
– Introduce malicious code, bots, or scraping tools.
– Use the Website for commercial gain, resale, or redistribution.
– Misrepresent your identity or affiliation with Music Duo Academy.
Violations may result in immediate termination of your access and potential legal action.
9. Affiliate Disclosure
Music Duo Academy may include links to third-party partners such as West Music or Sonor. We may receive a commission for qualifying purchases made through these links, at no additional cost to you. These partnerships do not influence our course content or recommendations.
10. Data Privacy and Compliance
Your use of the Website is governed by our Privacy Policy. We comply with U.S. laws including the Children’s Online Privacy Protection Act (COPPA) and applicable state laws such as the California Consumer Privacy Act (CCPA/CPRA) and the Texas Data Privacy and Security Act (TDPSA).
We do not sell or share user data for marketing purposes. We may collect limited technical information to support user accounts and improve functionality, as described in our Privacy Policy. In partnership enrollment scenarios, Music Duo Academy may receive parent or guardian contact information from authorized institutional partners solely for the purpose of account creation and course-related educational communications. This information is never used for unrelated marketing purposes without prior written consent from the parent or guardian.
10a. Partner Enrollment and Educational Communications
Music Duo Academy partners with select educational institutions and homeschool platforms to offer courses to enrolled families. In these arrangements, a partnering institution may submit a parent or guardian’s name and email address to Music Duo Academy for the sole purpose of creating a student account.
Upon receiving enrollment information, Music Duo Academy will issue a one-time registration code to the parent or guardian’s provided email address. Account activation requires the parent or guardian to complete registration on the Music Duo Academy platform and agree to these Terms of Use and our Privacy Policy.
As part of the educational service, Music Duo Academy maintains regular communication with enrolled families, typically on an approximately bi-weekly basis, to inform parents and guardians of upcoming lesson content and learning objectives. By activating your account and accepting these Terms, you consent to receiving these educational communications. You may opt out of nonessential communications at any time by contacting support@musicduoacademy.com, though opting out of core educational communications may affect your ability to fully utilize the platform.
11. Geographic and Accessibility Notice
Music Duo Academy is operated in the United States and intended primarily for U.S.-based users. Access from other countries is at the user’s own risk and responsibility for compliance with local laws. We strive to make our Website accessible to all users and welcome feedback to improve accessibility.
12. Disclaimer of Warranties
The Website and all content are provided on an “as is” and “as available” basis without warranties of any kind. We make no guarantees that the Website will be uninterrupted, error-free, or that defects will be corrected. Your use of the Website is at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, Splendor Productions LLC, its affiliates, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the Website or its materials.
14. Indemnification
You agree to indemnify and hold harmless Splendor Productions LLC, its affiliates, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Website or violation of this Agreement.
15. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Collin County, Texas, unless otherwise required by law. The Company reserves the right to require binding arbitration for disputes related to these Terms.
16. Severability and Entire Agreement
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and the Company regarding your use of the Website.
